Washington Couple Using Medical Marijuana Alleges CPS Kidnapped And Scheduled Adoption For Their Children
Twenty-two-year-old Sophia Rosas and her fiance, Twenty-three-year-old Sean Kilkenny have been living every parent’s worst nightmare for the past two years in Bremerton, Washington.
For the past two years, the couple has been fighting an ongoing battle with CPS for the rights to there children.
The incident began in November of 2018 with an accident involving the child and the father, when the mother took her child, Zurius, to Silverdale Harrison Hospital in Bremerton, Washington for a spiral fracture in his arm.
While at the hospital Rosas was attempting to explain how the child may have received the injury while potty training with his dad.
She said Sean had come out of the bathroom stating that he was worried because Zurius was upset about his arm and that he would not calm down.
She claims they put the child to bed despite him saying his arm was hurt but when the woke up the next morning Zurius’s arm had become purple and swollen.
They rushed him to the emergency room where the hospital placed an emergency hold on Zurius because the description of how his arm became injured did not match the injury.
Zurius was hospitalized and Sophie sent home.
When she reached home she and her husband Sean realized that Zurius had received the injury from when Sean had been playing with the child. Sean had been tossing him into the air and he had landed wrong on his arm, this is when they believed he had received the injury. When social workers had interviewed them, they had attempted to inform them of what happened to Zurius. This did not go well for them because they changed their story and the case worker did not find Sophia to be truthful which led Sophia into a dependency case with the local Department of Children, Youth, and Families office.
Sophia was “founded” by the Department to have failed to protect Zurius, and Sean was “founded” of child abuse. Neither parent was charged with any crime, neither was given a trial to determine the truth of the matter, and neither were aware of their option to appeal the Department’s decisions.
From here on out, they had been jumping through hoops trying to prove to CPS that they are fit parents that could properly take care of their child.
They ended up in the Kitsap County Juvenile Court, where the shelter hearing was supposed to take place but had been pushed back numerous times before finally resuming trial. And in this time Sophia had been corrected numerous times by her public defender to sign a safety plan and completing assessments for the department.
Zurius was placed in the maternal Aunt’s home. And because Sean was not his biological father he was not involved with this safety plan when she agreed, believing like others in her situation, that she had no other options but to comply, she had been struggling to balance the demands from the CPS department and her medical conditions, as well as the weekly visits with her son. But she had been blessed a year later with her newborn child Riley on November 21, 2019.
Almost immediately after Riley was born, their caseworker Tina Whitney had Riley placed on an emergency hold, due to the petitions against both parents. They sadly had to leave the hospital without there child once again.
Both parents were doing good despite the outbreak of the Coronavirus, seeing as everything had been shut down in Washinton State, preventing them from completing any required service or assessments. At their next review hearing, both parents had been acknowledged by the department and the court that they had been in compliance with all the required services and would have, most certainly continued if the pandemic had not happened. And in May 2020, their public defender filed a motion for Riley to return home, which was successful on July 16, 2020.
But sadly this happy reunion was not left unscathed, their current social worker, Joni McDairmant, and the department filed another petition to remove Riley from the home solely due to their use of medical marijuana use. At this time Zurius had been moved to a foster home that is believed to be a potential adoption home. Sophia suffers from a pain caused by having her gallbladder removed, and constant digestive tract inflammation that results in nausea and vomiting. Her conditions resulted in occasional malnourishment because her internal organs are webbed together with scar tissues from years of inflammation, and she has been dealing with this since the age of eight. And Sean Suffers from a fusion of his lower backbone and degenerative disc disease and has, like many other patients, continued to utilize Washington’s legal recreational program to obtain his medicine as he cannot afford the two hundred medical recommendation.
A hearing was set for August 25, 2020, with Commissioner Matther Clucas Pesideing, although he did not remove Rily from their home he was hesitant in denying the Department’s motion, He ordered that both parents refrain from using Marijuana entirely. If they did not comply then Riley would be taken away from them
Sophia and Sean have been forcefully exposed to the corruption of child protection services. Between the assessments and services that never-ending cycle of files being rejected by social workers or appointments never being made properly, as well as the unending demands made throughout the case. Both parents had submitted numerous urine analysis tests and attempted to use the chemical Dependency Sevices since COVID-19 shutdowns happened last March, despite their disagreement with the diagnosis, even being told that their use of marijuana was fine so long as they keep their levels low.
While this was happening Washington DCYF also motioned for Termination of Parental Rights for Sophia and Zurius biological father, as well as changing the permanency plan for Zurius to adoption within six months. The hearing has been placed for October 13, 2020. Sophia state that she has no idea why they are attempting to adopt out her son.
Then things took a turn for the worst on September 4, when their social worker, Joni McDairmant, was supposed to arrive at 1 p.m. to check on Riley. Sean and his mother Jennifer were going to take Riley downstairs to meet her for the appointment, seeing as Sophia had recently been tested positive for COVID-19 after a possible exposure from their neighbor.
After waiting for an hour, Sophia had texted Joni informing her that Sean and Sophia had errors to run that day, Jennifer replied that Riley was not to leave otherwise she would call the police. Sophia replied that she understood and continued to wait for her arrival but sadly police arrived as, Joni McDairmant and CPS investigators, Gregory Fontenette.
The CPS Department had used Commissioner Clucas’ Vvague order and a failed UA from a week after the order was given, and Riley was removed from his parent’s custody and was placed in a foster home, despite there being a family friend being president and more than willing to take him in. The social worker did not allow them to pack a bag or to say goodbye.
Family Advocate from Fight for Lilly, Serra Frank, has reviewed the paperwork and is now working with the family. It was obvious to her and those who looked over the paperwork, that Kitsap County Washington Department of Children’s end goal was not to reunite the family. She stated by filing to discharge the public defender that was not adequately speaking on their behalf, and that she was more than ready to fight them head-on. Sophia also filed a revision of Commissioner Clucas’s ruling regarding her medical marijuana use, the hearing was set for September 16, 2020.
They have been scheduled to appear in front of Commissioner Clucas on September 9, 2020, at 9 p.m. PST. The hearing is about the compliance order that mandates they stop using medical Marijuana, and the new shelter care hearing for Riley. And she will also be requesting that Riley be returned home with them.
Former CPS investigator Carlos Morales and Senator Nancy Schaefer had shouted warnings about this case once they had read the reports, as it was clear that the intention of the Kitsap County Department of Children, Youth, and Families (DCYF) was to have the children adopted instead of returning the children home.
