Texas Parents Sue Apple After Son Suffered Hearing Loss From Amber Alert On AirPods

On Monday, in San Antonio, Carlos Gordoa and Ariani Reyes filed a lawsuit against Apple. They claim that an Amber Alert, that went off as their 12-year-old son was wearing AirPods, damaged his ear.

The parents of the boy identified as “B.G.” stated that their son was watching Netflix on his iPhone with AirPods connected. It was at a “low volume” when the Amber Alert sounded in 2020.

The volume of the sound “tore apart B.G.’s ear drum, altered his cochlea, and resulted in extensive injuries to B.G.’s hearing,” court documents note.

It also stated that the child “suffered sudden and permanent hearing loss in his right ear.” Additionally, he has experienced dizziness, vertigo, nausea, and tinnitus.

The parents claim that Apple was grossly negligent and committed fraud. They say that the AirPods are made incorrectly as sounds alert at very “ear shattering sound levels.”

“The boy’s life has been severely altered because Apple didn’t provide a warning about the volume levels of its AirPods, leading to his permanent hearing loss,” the family’s lawyer said.

The lawsuit states that there are hundreds of people that have complained about not being able to adjust the volume.

“Please fix this. I literally threw my AirPod across the room when I got a shrill text alert while listening to peaceful music. Not cool,” wrote one user on Apple’s support website.
