61-year-old Brian Michael Gaherty, of Houston, Texas, has been given a 33-month prison sentence after threatening to kill Rep. Maxine Waters.
On Monday, Gaherty received his punishment and was fined $10,000 by a federal judge. After determining that he targeted Waters, who is Black, because of her race, a hate crime enhancement was applied to the punishment.
During the sentencing phase of the hearing, Waters stated that her family members are constantly in fear due to the threats that Gaherty made against her.
“This growing effort to target people of color and women of color…has given me nightmares. I am in fear of my life,” Waters stated.
In January, Gaherty pled guilty to one count of threatening a U.S. official and confessed to threatening assault and to kill Waters in four various voicemails. All of those messages had talks of “violent threats, profanity, and racist and misogynistic language,” the U.S. Attorney’s Office noted.
Back in August 2022, Gaherty had first threatened to kill Waters, saying that she better “move” because he had a contract on her life. After officials told him to stop, in November of that year, he threatened Waters again because she had contacted authorities.
In April 2023, Gaherty was indicted on four counts of making threats in interstate communications and four counts of threatening a U.S. official.
Gaherty’s attorney, Joseph Vinas, reported that his client has apologized to Waters. He also stated that his client’s actions were a result of a “mental health condition he currently suffers as a result of being the victim of violent crime himself.”
