The Lake Jackson Police Department announced the conclusion of an investigation for an incident on March 4 regarding two officers.
Officer Johnny Cagle and Officer Mendoza arrested a citizen, Mr. Reyes, who was legally videotaping a traffic accident. This interaction between officers and the citizen was not lawful and was done in error.
Once the PD noticed the unlawful arrest, the citizen was released and an internal affairs process began.
Before conclusion of the investigation, the police department accepted the resignation of Officer Cagle. Officer Mendoza, who was also a subject of the investigation, will receive a period of unpaid leave and is required to participate in remedial training in the areas of law of concern in this incident.
The Lake Jackson Police Department and the District Attorney’s Office are discussing if the officers will face criminal responsibility.
Mr. Reyes has since hired an attorney and plans to file a civil lawsuit against the officers.
