The family of an Ohio man that was fatally shot on New Year’s Day by police is demanding justice.

On New Year’s Day, Canton officer, Robert A. Huber responded to a shots fired call around midnight.

As the officer arrives to the residence in which the shots were fired, he is seen approaching the area, which is behind a privacy fence. He immediately opens fire, without warning, striking 46 year old James Williams.

Williams was transported to an area hospital where he later died.

According to a press release from The Canton Police Department, they stated that the officer confronted a subject that began shooting a firearm.

“The officer, in fear for his safety, fired his duty weapon at the subject and struck him,” according to the press release.

In the police bodycam video the officer is seen approaching the fence after hearing gunshots. He then fires multiple shots into the fence. No warning or command is heard being given until after the officer fires multiple rounds.

Williams wife, Marquetta is now demanding justice for her husband. She says her and her husband were in their backyard ringing in the New Year when the officer opened fire.

Marquetta also said that her husband was behind a 6ft high fence and had no knowledge of the officer on the other side.

The Ohio Bureau of Criminal Investigation is handling this incident. The circumstances leading up to the shooting are still being determined.

Canton Police Chief Jack Angelo said he is following proper protocol. Huber has been restricted from police duty and placed on office duty.
