The Dallas ISD is suing a 7 year old boy, who is also a former student, over the right to test him for autism.
Dallas school district is appealing in a Federal Court saying that the federal law requires students to be tested for any suspected learning disabilities. The Texas Education Agency has sided with the parents in her decision twice even though the child has been diagnosed by a doctor with ADHD and dyslexia.
The school believes the child may have autism and asked for consent to test him.
They say they are only trying to comply with federal law requiring them to provide all students with the proper education.
The boys mother Angela Bolton- Smith, who is a special ed teacher for DISD and has also worked as a diagnostician evaluating special needs children has refused them the right to test her child.
The DISD administration released in a statement “The individuals with Disabilities Education Act mandates school districts to test in every aspect of suspected disabilities.”
