Corey Marioneaux Jr., will not face criminal charges for shooting at Pensacola Police SWAT officers when they entered his home in Pensacola, Florida.

On February 3, Marioneaux was charged with attempted murder of a law enforcement officer after he fired at a PPD SWAT team member.

The SWAT team was entering his home lawfully to execute a search warrant.

Marioneaux’s attorneys, James Bryant, Carlos Moore, Rodney Diggs, and Reganel Reeves argued that SWAT did not wait the appropriate amount of time before ramming in his door.

In a press release, The State Attorney’s office announced their decision to not pursue criminal charges. They say Marioneaux’s actions following the shooting were sincere.

They explained that he exhibited shock and immediately put his firearm down, apologizing and saying he didn’t know it was the police.

On Feb. 24, Marioneaux Jr.’s attorney James Bryant announced plans for state and federal lawsuits for Marioneaux’s children against Pensacola Police and Escambia County EMS.

Marioneaux’s two children, ages 1 and 3, were inside the home when shooting took place. Following the incident, police took the children into their custody.

While in police custody, Cylen, 1, fell out of the back seat of a police cruiser and injured his face, nose, and head.

The department claims both kids were with an investigator during the time of the incident. The investigator got out of the car, leaving the children in the backseat.

Upon returning, Pensacola Police claim the investigator didn’t notice the child leaning on the door. The investigator opened the door and the child fell out.

Police called EMS to the scene for medical attention. Escambia County EMS checked the baby and released him back to family members. Cylen was not taken to the hospital for treatment.

The internal affairs investigation is still ongoing.
