Former Dallas police officer Amber Guyger’s attorney has filed for an appeal to be charged with a lesser crime.
Guyger was convicted of murder last October after she went into the wrong apartment and killed an unarmed man.
She claims she returned home from work on September 6,2018 and went to what she thighs was her apartment. The door was slightly open she proceeded to enter , saw a man inside on the couch and opened fire striking and killing Botham Jean,26.
Jean who lived a floor above Guyger was pronounced dead at the scene.
Guyger was sentenced to 10 years in prison.
Her defense team has now filed an appeal to have the murder conviction reduced to a lower felony count and get a new punishment hearing.
Mike Mowla who is one of Guyger’s attorneys and he claims the evidence was legally insufficient to prove beyond a reasonable doubt that she committed murder and that if anything she is guilty of negligent homicide.
In Texas, the punishment for criminally negligent homicide ranges from 180 days to two years with probation being possible.
If a weapon was used the charge is then a third degree felony punishable by a maximum 10 years behind bars.
