As noted in a federal lawsuit that was filed on Monday, four Houston police officers are said to have racially profiled a Hispanic man. They then hogtied him as he was being apprehended.
Scott Erwin, Jennifer Gilbreath, Hallie Smith, Frederick Morrison, and Gino Dago have been named as the HPD officers that were involved. The lawsuit states that the officers violated the Fourth Amendment Rights of Albert Ramos by using excessive force as he was apprehended without probable cause.
In July 2021, Officer Erwin had arrived to a scene after some called 911 to report a Hispanic man physically assaulting a woman. Although the description given by the dispatcher only stated that it was a Hispanic man, Erwin stopped Ramos, who was walking home after a night of dancing, to speak with him.
The lawsuit notes that Ramos showed no aggression towards the officers; however, Erwin grabbed Ramos’s arm and took him to ground prior to asking any details regarding the information on the 911 call.
After Ramos pleaded for help, asked questions, and made statements in English and Spanish, Officers Smith, Dago, and Morrison arrived on the scene. They then took Ramos out of a police vehicle where he was still handcuffed. They then took him to the ground again and hogtied him, the lawsuit added.
Following the incident, Ramos was placed in the hospital. He was charged with assaulting a peace officer, but never faced any criminal charges in relation to the accusations made in the 911 call.
For almost thirty years, the U.S. Department Of Justice has issued warnings about the dangers of hogtying because it can lead to suffocation. Results indicate that from 2010 to 2021, 23 people died at the hands of the police after being hogtied.
