Judge Says 16 Year Olds Can’t Have An Abortion Because ‘They’re Not Mature Enough’

Florida’s first district court of appeals denied a 16-year-old’s request to get an abortion on Monday.

Abortions are legal in the state of Florida, however, anyone under the age of 18 is required to provide consent from their parent.

The 16-year-old girl petitioning the court to bypass this requirement noted that her guardian has given her the okay to get the procedure done.

According to the court document, the girl filled out the information incorrectly and wrote her responses in “out-of-place” sections of the form. Therefore, the judge says she was not provided with the needed information and the girl’s actions also demonstrate that she’s not mature enough to make the decision by herself.

According to the judge, when the 16-year-old can “adequately articulate her request” she could try again in court.

Of course, if the teen can abide by The Parent Consent Law, she still always has the option of receiving an abortion. In her case, she’d need to present a written waiver from her guardian.
