Walmart Worker With Down Syndrome Awarded $300K After Being Fired; Walmart Seeks New Trial

Walmart has asked for a new trial in a disability-discrimination lawsuit that ended in July after lasting for six long years.

The lawsuit focuses on the termination of Marlo Spaeth, a worker with Down Syndrome. She was an employee at a Walmart in Wisconsin for 16 years.

In July, a jury awarded Spaeth $125 million after they agreed that Walmart violated the Americans with Disabilities Act.

The maximum amount permitted under federal law is $300,000. Thus, the award was later lessened.

In 2015, Spaeth was terminated for being absent from work on many occasions. This was after Walmart moved to a digital timetable system. This changed her work schedule that she had for many years. When Spaeth and her sister kept asking for her longtime schedule, she was fired.

Walmart would now like a new trial. They say that managers didn’t know Spaeth,’s “difficulty adjusting to her new schedule was linked to her Down Syndrome.” Thefore, the company says that Spaeth’s firing wasn’t caused by “malice or reckless indifference” toward her disability.

In March, a federal judge ruled that Walmart must hire Spaeth back. The company agreed to do so. No official start day has been determined.
