$100 Million Lawsuit Filed Against Amazon After Man Loses Leg In Accident With Delivery Driver

A motorist from North Carolina is filing a $100 million lawsuit against Amazon. He says the company has unrealistic expectations for their delivery drivers, and it has led to negligence.

Justin Hartley lost his leg after an accident with an Amazon delivery truck in Virginia Beach, VA, on October 4. The delivery driver, who was operating a rented truck with an Amazon label on it, turned straight into the lane where Hartley was.

The truck struck Hartley, breaking his left wrist and leg. Doctors couldn’t save his leg, and it had to be cut off above the knee.

Court documents note that Christopher Gill, the delivery driver, confessed to police that he was distracted. He was looking down at his GPS directions on his Amazon-issued navigation system.

“The driver was so entranced in making his delivery that he didn’t see our client,” Hartley’s attorney has said.

In response, Amazon has said that the lawsuit didn’t “implicate a legal or contractual responsibility owed on behalf of Amazon.”

Amazon drivers use the Flex App. It helps with the timing of directions, routes to take, when to take breaks, and when to return back to their station. When a driver is late, they receive text messages to help them get back on track. If they don’t, it could affect their pay.
