Detection Of Marijuana No Longer Probable Cause For Legal Action If Bill Is Passed

A law maker in South Carolina is pushing for a bill that will protect those around marijuana. The bill would prohibit law enforcement from using the scent of marijuana as probable cause to search, seize, or arrest.

Marijuana is still considered an illegal substance in South Carolina. Hemp farms are legal, however, with a permit. Representative Deon Tedder says the bill is set to protect Hemp farmers and also minorities.

The American Civil Liberties Union reported that Black people are 3.5 times more likely than White people to be arrested for marijuana possession in South Carolina.

If the bill is passed, it would prevent law enforcement from stopping and searching a person or motor vehicle simply because the smell of marijuana is detected. Whether it’s cannabis, hemp, or marijuana that’s detected, it can not be “probable cause” for legal action to be taken.
